Bosch Car Service Promotion – August and September 2017

CONDITIONS OF ENTRY

1. Information on how to enter and the prize form part of these Conditions of Entry. Entry into this Promotion is deemed to be an acceptance of all Conditions of Entry.

2. The Promotion commences on 1st August, 2017 and concludes at close of business on 30th September, 2017 (“Promotional Period”).

3. Entry is only open to residents of Australia and New Zealand aged over 18 years or over, who submit a valid entry within the Promotional Period in accordance with these Conditions of Entry. Employees (and their immediate families) of the Promoter (i.e. Robert Bosch (Australia) Pty Ltd) and Bosch Car Service workshops, agencies, suppliers, retailers or companies associated with this Promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

4. To enter, entrants must undertake the following steps during the Promotional Period:

  • Have the brakes on their vehicle serviced or repaired at any Bosch Car Service workshop in Australia or New Zealand;
  • Complete the official entry card (available at Bosch Car Service workshops) including their full name, residential address, contact telephone number; and
  • Drop it into the entry box at the Bosch Car Service workshop.

5. Multiple entries permitted, subject to the following: (a) only one (1) entry is permitted per vehicle that has its breaks serviced or repaired at a Bosch Car Service workshop; and (b) each entry must be submitted separately and in accordance with entry requirements.

6. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

7. The draw will take place on 27th October, 2017 at 10:00am (AEDST) at Robert Bosch (Australia) Pty Ltd, 1555 Centre Road, Clayton Victoria 3168 Australia. Winners will be notified by phone and email within two (2) business days of the draw. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. Winner’s names will be announced in The Australian on 3rd November, 2017.

8. There will be five (5) winners drawn. The first five (5) valid entries drawn, from all valid entries received, will each win their money back for the amount of their brakes service/repair (as per the invoice), up to the maximum value of $1000 RRP. Prize value is in the local currency of the relevant winner (i.e. up to AU$1,000 for Australian residents and up to NZ$1,000 for New Zealand residents, as per the relevant invoice).

9. The total prize pool value is $5,000.

10. Entrants must retain purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the Bosch Car Service workshop, the services performed and the amount chared and that the brakes service/repair was conducted during the Promotional Period but prior to entry.

11. The Promoter reserves the right to verify the validity of all entries and to disqualify any entrant who interferes with or fails to comply with the correct entry process, or who submits an entry which is not in accordance with these Conditions of Entry.

12. Incomplete or incomprehensible entries will be deemed invalid. The Promoter accepts no responsibility for any entries that are lost, late, misdirected or not received by the Promoter within the Promotional Period or for any delays in the delivery of entries due to technical, postal disruptions or for any other reason.

13. Prizes must be taken as offered and cannot be varied exchanged.

14. In the case that a prize is unclaimed after a 3 month period a redraw will take place on 29th January, 2018 at 10:00am at Robert Bosch (Australia) Pty Ltd, 1555 Centre Road, Clayton, VIC 3168. Winners (if any) will be notified by phone and email within two (2) business days of the draw. Winner’s names will be announced in The Australian on 5th February, 2018.

15. The Promoter’s decision in relation to any aspect of the Promotion is final and binding on every person who enters and no correspondence will be entered into.

16. The Promoter and its officers, employees, related bodies corporate and agents will not be responsible for any incorrect, inaccurate or incomplete information received or not received in the course of or in connection with this Promotion if the deficiency is occasioned by any cause outside the Promoter’s reasonable control including but not limited to technical malfunctions or failures.

17. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached these Conditions of Entry, or engaged in any unlawful or improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

18. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

19. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

20. Nothing in these Conditions of Entry limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia or any statutory consumer guarantees as provided under consumer protection laws in New Zealand (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

21. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Conditions of Entry; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.

Bosch is bound by the Australian Privacy Principles in the Australian Privacy Act 1988 and the Information Privacy Principles described in the New Zealand Privacy Act 1993. We collect personal information about entrants to enable entrants to participate in this promotion. If personal information is not provided, the participant may not participate in this promotion or be contacted if they are a winning entrant. Such personal information may be used by Bosch and any authorised service dealers for the purpose of performing this promotion. We take steps to protect the personal information we hold against loss, unauthorised access, use, modification or disclosure, and against other misuse. When the personal information that we collect is no longer required, we destroy or delete it in a secure manner. You can access the personal information that we hold about you, and you can ask us to correct the personal information we hold about you by contacting us at the Bosch contact details below. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. We do not disclose Australian entrant’s personal information to any entity outside of Australia.
